Terms of Service
1. Acceptance of terms
By accessing or using RetroCanvas ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
2. Description of service
RetroCanvas is a web-based collaboration tool that enables agile teams to run retrospective sessions. Features include boards, columns, cards, voting, grouping, comments, timers, and export functionality.
3. Accounts
You may use some features anonymously. To create an account you must provide a valid email address, a name, and a password. You are responsible for keeping your credentials secure and for all activity that occurs under your account.
You must be at least 13 years old (16 in the EEA) to create an account. By registering, you represent that you meet this requirement.
4. Acceptable use
You agree not to use the Service to:
- Post content that is unlawful, defamatory, harassing, abusive, or obscene
- Infringe any intellectual property or privacy rights of others
- Transmit malware, spam, or unsolicited communications
- Attempt to gain unauthorized access to the Service or other users' accounts
- Reverse engineer, scrape, or systematically download content from the Service
- Use the Service in a way that could damage, disable, or impair its operation
We reserve the right to suspend or terminate accounts that violate these rules.
5. User content
You retain ownership of the content you create on RetroCanvas (board text, cards, comments). By posting content, you grant us a limited, non-exclusive license to store, process, and display that content solely to provide the Service to you and your collaborators.
You are solely responsible for your content. We do not review user-generated content and are not liable for it.
6. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes what data we collect and how we use it.
7. Third-party integrations
The Service offers optional integration with third-party platforms such as Jira. Your use of those integrations is subject to the terms of the respective third parties. We are not responsible for third-party services.
8. Intellectual property
All software, design, trademarks, and other materials comprising the Service (excluding user content) are owned by or licensed to us and are protected by applicable intellectual property laws. You may not copy, modify, or distribute them without our written permission.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $50.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, with or without notice.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) shall survive.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which RetroCanvas operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
